Payment Terms: Full payment by wire transfer is required before order processing and shipping. No payment plans, installments, or credit terms are available. Orders will not be processed until payment is received and verified in our account.
Prices for our products are subject to change without notice. We reserve the right to modify or discontinue any product or service without notice at any time. We reserve the right to refuse any order placed through our website. We may, at our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
4. Inspection Period
Mandatory Inspection: Customer must thoroughly inspect all products within 2 calendar days of delivery and notify us in writing of any defects, damage, discrepancies, or non-conformity within this period. Failure to provide such written notice within 2 days shall constitute final acceptance of the products and complete waiver of all claims regarding condition, conformity, or performance.
5. Shipping and Delivery
Shipping times are estimates only and cannot be guaranteed. We are not liable for any delays in shipping or receiving your order regardless of cause. Risk of loss, damage, and title for all products purchased pass to you upon delivery of the product to the carrier. We are not responsible for lost, stolen, or damaged packages once delivered to the carrier.
6. Returns and Refunds
Return Period: Returns are only accepted within 7 calendar days from the date of delivery, subject to the conditions below.
Eligible Items: Only items currently listed on our website are eligible for return. The following items are strictly non-returnable and non-refundable:
- Special orders and custom orders
- Items modified or customized to customer specifications
- Liquidation items and clearance products
- Items not in original packaging or condition
- Items showing signs of use, wear, or damage
Return Costs: Customer is responsible for all return shipping costs, insurance, customs duties, handling fees, and any other charges associated with the return, regardless of reason for return.
Restocking Fee: All approved returns are subject to a 15% restocking fee to cover processing, inspection, repackaging, and administrative costs. This fee is deducted from any refund amount.
Return Authorization: No returns will be accepted without prior written authorization from ALPA Pro. Unauthorized returns will be refused and returned to sender at customer's expense.
7. Warranty
Manufacturer Warranty Only: Products are covered solely by manufacturer warranties, if any. ALPA Pro makes no additional warranties and expressly disclaims all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not responsible for warranty claims, repairs, or replacements.
8. Intellectual Property
All content included on this website, such as text, graphics, logos, images, digital downloads, data compilations, and software, is the property of ALPA Pro or its content suppliers and is protected by international copyright laws. Unauthorized use is strictly prohibited.
9. Comprehensive Limitation of Liability
Maximum Liability: ALPA Pro's total liability to you for any claim arising from or relating to these terms or your use of our website or products shall not exceed the purchase price of the specific product(s) giving rise to the claim.
Excluded Damages: In no event shall ALPA Pro be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, regardless of whether we have been advised of the possibility of such damages.
Force Majeure: We shall not be liable for any failure or delay in performance under these terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, supplier delays, or shipping carrier delays.
Product Performance: We make no representations or warranties regarding product performance, compatibility, or suitability for any particular purpose. Customer assumes all risks associated with product selection and use.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed exclusively in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of our website shall be subject to the exclusive jurisdiction of the Swiss courts. Customer waives any objection to venue or jurisdiction in Switzerland.
11. Severability and Enforcement
If any provision of these Terms is deemed invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term.
12. Changes to Terms
We reserve the right to update, change, or replace any part of these Terms of Service at any time without prior notice by posting updates and changes to our website. Changes become effective immediately upon posting. It is your responsibility to check our website periodically for changes. Your continued use of our website following the posting of any changes constitutes acceptance of those changes.
